RULES AND REGULATIONS
Welcome to the “SCENE Call Centre Survey Contest” (“Contest”).
By entering this Contest, you acknowledge that you have read, understood and accept the terms and conditions below.
Sponsor: Scene General Partnership (“Scene GP” or “Sponsor”) is the sole sponsor of this Contest. Bond Brand Loyalty Inc. (“Bond” or “Administrator”) is responsible for administering the Contest on behalf of the Sponsor.
1. How to Enter:
NO PURCHASE NECESSARY. Contest begins on November 1, 2014 and ends December 31, 2017, with fourteen Contest Periods, as defined below. Each Contest Period commences 12:01 am EST on the first day of every month (1st), ending at 11:59pm EST on the final day of the month (30th or 31st) (each month will be a unique “Contest Period”). All entrants must be existing members of the SCENE loyalty program (“SCENE”) with an account in good standing (for the purpose of this Contest, “good standing” means not cancelled or suspended) as of the start of the Contest Period in which they are entered or become SCENE members during that Contest Period, and maintain their SCENE membership throughout the Contest Period.
SCENE members who contact the SCENE cell centre, either by phone or via email, regarding their SCENE account may receive a survey about their call centre experience, by email to the email address associated with their SCENE account. SCENE members who receive the survey will have 30 days to complete it from the date the email was sent. After the 30 days, the survey will be closed. Each survey will have a unique URL and can only be responded to once. The SCENE member must have opened and completed the targeted survey that was sent to them in a unique email following a Call Centre interaction. The member will be entered into the Contest during the month that they complete the survey.
The odds of winning a Prize depend on the total number of eligible entries received during each respective Contest Period. Entries received will be discarded at the end of each Contest Period and not carried over into subsequent Contest Periods. SCENE members are eligible to win one Prize from this Contest every six months.
There is one Prize available per month to be won (the “Prize(s)”), consisting of 1,000 SCENE Points. Approximate retail value per SCENE member: $10.00 CDN. SCENE points will be automatically deposited into the SCENE account of the winner once the verification process has been completed.
All Prizes must be accepted as awarded without substitution and are not transferable or redeemable for cash or allowed to be sold. The Sponsor reserves the right to substitute any prize with one of equal or greater value in the event that all or any of the components of any Prize are unavailable. In the event that a winner is unable to redeem the Prize due to reasons beyond the control of the Sponsor, its employees, representatives, agents and all parties associated with this Contest, no compensation or substitution prize will be provided.
3. Prize Drawing:
The draw for the Prize will occur on the 1st business day of every month. A random draw will occur including all SCENE members that have completed the survey in the previous month. The selected SCENE member will be contacted via telephone or email by the Sponsor the day following the draw. Once contacted, the selected SCENE member will have 5 days to accept the Prize. The selected SCENE member will be required to correctly answer a mathematical skill testing question, unaided and time limited and may be required to sign a declaration confirming understanding of, compliance with, and acceptance of the Contest rules and acceptance of the Prize, as awarded and a standard release of all liability satisfactory to the Sponsor before being declared the Prize winner.
Contest is open to SCENE members who are legal residents of Canada and have reached the age of fourteen (14) before the end of the Contest Period in which they are entered. Sponsor reserves the right to verify the age of selected Prize winners and without verification to the sole satisfaction of Sponsor, to deny entry to that entrant. Contest is not open to employees and those domiciled with employees of Cineplex Entertainment (“Cineplex”), The Bank of Nova Scotia (“Scotiabank”), Scene GP, or the Administrator or any of their respective parent, subsidiary or affiliated companies (collectively, the “Released Parties”). Sponsor reserves the right to verify potential prize winners are not an employee (or domiciled with employees) of one of the Released Parties, and without verification to the sole satisfaction of Sponsor, to deny entry to that entrant. Void where prohibited.
5. General Rules:
The Released Parties shall not be liable for entries that are lost, late, incomplete, misdirected or not received. By entering this Contest, entrants accept and agree to be bound by these rules and the decisions of the Sponsor or Administrator, which are final, binding and conclusive on all matters relating to this Contest. All entries become the property of the Sponsor and none will be returned and no correspondence will be entered into except with the selected entrants who will be notified by telephone or e-mail. The Sponsor reserves the right to disqualify all entrants who fail to follow these Contest rules or who make any misrepresentation relating to the Contest, drawing and redemption of the Prizes. Entry constitutes permission to use the winner’s name for publicity purposes without additional compensation or permission, except where prohibited by law. This Contest is subject to all applicable federal, provincial and municipal legislation and subject to the jurisdiction of the Régie des alcools, des courses et des jeux en Québec (“RACJ”).
At Scene GP, we are committed to respecting your privacy rights. Any personal information that we gather will be handled in strict accordance with our privacy policies, available at scene.ca and all applicable privacy legislation. Scene GP will not sell your personal information collected for this Contest to any third parties. Any personal information collected for this Contest shall be used by Scene GP as is disclosed herein. Please note that by submitting personal information to enter this Contest, you consent to Scene GP’s use of your personal information in order to manage and administer this Contest.
7. Technical Difficulties and Tampering:
The Released Parties shall not be responsible for any failure of the website during the Contest or for any problems or technical malfunction of a telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail, on-line, or Internet connection, cell phone failure or malfunctions, or any problems or malfunctions attributable to any cell phone network provider. In addition, the Released Parties shall not be responsible due to technical problems, traffic congestion on the Internet or at any website, failure of handset or mobile web browser, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer or property related to or resulting from playing or downloading any material in the Contest. The Sponsor reserves the right, at its sole discretion to cancel or suspend this Contest should a virus, bug or any other cause beyond the reasonable control of the Sponsor or Administrator corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. In addition, any attempt to undermine the legitimate operation of this Contest may result in the cancelation or suspension of the offending entrant’s SCENE membership and/or SCENE points, by Scene GP in their sole discretion. Entries are subject to verification and will be declared invalid if they are illegible, incomplete, mechanically reproduced, forged, falsified, altered or tampered with in any way.
8. No Liability:
The Released Parties shall not be responsible in any way for the use of, or bear any liability whatsoever in any way attributable to, the Prizes awarded in this Contest or the events forming part of this Contest. By participating or accepting a Prize, all entrants release and hold harmless the Released Parties and their respective subsidiaries, affiliates, officers, directors, employees, representatives and agencies from any and all liability or any injuries, loss or damage of any kind arising from or relating to participation in this Contest or acceptance, use, misuse or nonuse of the Prizes or parts thereof, and from liability to any other persons relating to or in connection with this Contest.
9. Sponsor Has Final Say:
The decisions of the Sponsor and/or Administrator with respect to all aspects of this Contest are final and binding on all entrants without right of appeal.
10. Close of Contest:
Each Contest Period closes at 11:59pm EST, on the final day of each month. The Contest itself ends on December 31, 2017. However, Sponsor reserves the right, at their sole discretion, and with the consent of the RACJ, to cancel, terminate, modify or suspend this Contest or any portion hereof at any time for any or no reason without further notice.
In the event that it is not possible to award another entry due to discontinuance of the Contest for any reason, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for the Prizes offered herein.

12. For Quebec Only:
Any litigation respecting the conduct or organization of this Contest may be submitted to the RACJ for a ruling. Any litigation respecting the awarding of the Prizes may be submitted to the RACJ only for the purpose of helping the parties reach a settlement.
